There is a joke which says that the most dangerous time in Texas is when the Legislature is in Session.

However a few years back the Legislature did something really good for folks in their Estate Planning.

Traditionally a Power of Attorney is only good while a person is alive and mentally competent. Once a person became incompetent, then the Power of Attorney ceased to be effective. The alternative was to set up a Guardianship, which is an expensive and usually time-consuming procedure.

At the bottom of this page is a sheet which I have handed out for years now since the Texas Legislature created these four documents. We recommend executing these four documents at the same time you execute your Will. There is an explanation of what each of these documents does.

DOCUMENTS WHICH WE CAN PREPARE, WHEN WE DO PREPARE YOUR WILL

DIRECTIVE TO PHYSICIAN--document to allow physician with consent of two more physicians and spouse or other closest family member to allow person to die natural death without hooking up life sustaining equipment or to pull the plug and allow natural death.

SELECTION OF GUARDIAN--allows you to select person or persons to be your guardian(s) and to state any person or persons whom you do not want to be your guardian(s).

DURABLE POWER OF ATTORNEY FOR MEDICAL PURPOSES--allows you to determine the person or persons whom you want to make medical decisions when you no longer are able to do so.

DURABLE POWER OF ATTORNEY FOR BUSINESS AFFAIRS--allows you to determine the person or persons whom you want to make business decisions when you no longer are able to do so.
